Working in Cupertino

Building in Cupertino, one yard at a time.

Cupertino is mostly single-family neighborhoods developed from the 1960s on, including an Eichler tract area. The east side of the city is flat Santa Clara Valley floor, and the west rises into the Santa Cruz Mountains foothills. Neighborhoods include Monta Vista, Rancho Rinconada, Seven Springs, Oak Valley, Fairgrove and Garden Gate.

At San Jose, the nearest long-record station, rain averages about 15 inches a year, mostly November through March, with warm, dry summers. Valley-floor soil is alluvial, and a geotechnical report for a Vallco Parkway site found clay fill with moderate to high expansion potential, which is one reason we check the ground on every lot.

Before you build

What to know before you build in Cupertino.

Local ground, local rules and local habits that shape a good paver, concrete or fence job.

Fences up to 7 ft

No building permit or neighbor approval is needed up to 7 feet. Over 7 and up to 8 feet needs a building permit and written approval from abutting owners. In the front setback, fences are limited to 3 feet.

Front-yard paving

In the R1-a zone, impervious and semi-pervious surfaces may cover no more than 50% of the front setback area, and impervious surfaces such as concrete or asphalt no more than 40% of it. Other R1 zones may differ.

Driveway gates

Driveway gates need a building permit and Fire Department approval of the lock and location, and must be set back 30 feet from front and street-side property lines.

Protected trees

Cupertino's protected tree ordinance applies on private property in every zone. It covers heritage trees and specimen trees of listed species, including native oaks, buckeye, bigleaf maple, sycamore, cedars and bay laurel, at 12 inches in trunk diameter. Removal needs a tree removal permit with public notice.

Rules at a glance

Cupertino fence, wall and paving basics.

A plain-language summary of what the Cupertino code says, to help you plan. Codes get amended and every lot is different, so treat it as a starting point.

Fence height, elsewhere7 ft outside the required front setback. Corner lots have extra setbacks, and the sight triangles stay at 3 ft.
Fence permitNo building permit or neighbor approval up to 7 ft. Over 7 and up to 8 ft needs a building permit and written approval from abutting owners. Taller or non-conforming fences need a fence exception at a public hearing.
Fence on a retaining wallAn older city handout says a fence on top of a retaining wall needs a building permit at any height, so ask the Building Division.
Fence materialsBarbed wire, razor wire, chicken wire and electrified fencing are prohibited.
